Details of the Supreme Court of India's Ruling on Tinted Glass in Four-Wheelers in India

      $
      0
      0
According to the Central Motor Vehicle Rules- 1989, the glasses of windscreen and rear windows of vehicles should have a visual light transmission of 70 percent and for side windows it should be at least 50 percent.

Mr.Avishek Goenka had filed a petition in the Supreme Court of India, seeking complete ban on use of dark films on car windows, including the vehicles used by VVIPs, alleging that many crimes in cities were committed by people using such cars with tinted windows.

The petitioner, Mr.Avishek Goenka  had contended that he had 25 RTI query replies from various police stations to back his claim that many crimes, including sexual assault on women, were committed by offenders who used cars with tinted glasses to evade public gaze and conceal their identity.

On the above plea seeking complete ban on dark films in car windows, the Supreme Court of India ordered for enforcement of the ban on tinted glass on four-wheelers except factory fitted w.e.f.4th May 2012.

So, all the 'dark films’, irrespective of visibility level of 70%/50% fixed through car accessories stores stand banned now
      .

However, the Supreme Court Bench headed by Chief Justice S H Kapadia had made it clear that tinted glass can be used in vehicles of government officials for security purposes and asked the state governments to frame guidelines regarding this.

The present Chief Justice of India -Altamas Kabir (From 29th Septmeber 2012) has expressed his opinion that the Delhi -Gangrape could have been prevented if the above Supreme Court  order on tinted glasses was strictly followed and it is unfortunate that laws are not implemented until something bad happens in India.

Why Do "The South Indian Cinema Field"Artists- Fast Against the "Service Tax" in India?

      $
      0
      0
The Government of India had been planning to tax the services of the persons in the cinema industry, while extending service tax to many services.

Protesting against the government’s above decision to bring cinema industry under the “service tax”, the film industry had gone on a ‘one day’ token strike on 23rd February 2012.

However, the Government of India implemented the new ‘service charges’ w.e.f 1st July 2012, including the film industry under the service taxes (12.36%).

On 7th January 2013, the entire South Indian Cinema World observed a ‘one day’ fasting against ‘service tax’ on the film industry and the members of the following Unions/Associations participated in the ‘fasting’ -strike:
      • The SouthIndian Film Artistes’ Association
      • The Tamil Film Producers’ Council (TFPC)
      • The Federation of Film Employees’ Federation of South India (FEFSI)
      • The South Indian Film Chamber Of Commerce and
      • The Associations for Television artists
Already  the service tax  imposition has been effective since 1st July 2012.  As the next Annual Budget Session is due  to start next month the affected people of the cinema  field have started raising their united voices against service tax.

According to the Cinema Artists the imposition of 12.36% of Service Tax will add to the already increased cost of production and that they have been already paying ‘Income Tax’.

In response to  their agitations, the artists hope that the Government of India would exempt them from ‘service tax’.

Perhaps, the artists hope that the rate of service tax would be reduced from 12.36% , if not completely exempted or  at least the rate of tax would not be further increased in the next budget.
